Meetupcard Terms and Conditions

These Terms and Conditions (the "Terms") govern access to and use of the Meetupcard website, applications, dashboard, digital business card tools, lead capture features, AI CRM functionality, analytics, templates, QR code tools, NFC-related services, contact sharing features, and related products and services (collectively, the "Services") offered by PBINTELDATA Analytics LLP, operating as Meetupcard ("Meetupcard," "Company," "we," "us," or "our"). Meetupcard publicly presents itself as a digital business card, lead capture, and AI CRM platform, and its published legal pages identify PBINTELDATA Analytics LLP and its Gurgaon, Haryana address.[web:3][page:1][page:2]

By accessing, browsing, registering for, purchasing, or using any part of the Services, you agree to be bound by these Terms. If you do not agree, you must not access or use the Services.[web:2][page:1]


1. Eligibility and Authority

You represent and warrant that:

  • You are at least 18 years old and legally capable of entering into a binding agreement.[page:1]
  • If you use the Services on behalf of a company, employer, or other legal entity, you have authority to bind that entity to these Terms.
  • You will provide accurate, current, and complete information when creating an account or using the Services.


2. Description of Services

Meetupcard provides a cloud-based digital identity and business networking platform that may include, without limitation:

  • Digital business card creation and hosting.
  • QR code, link-sharing, and profile-sharing tools.
  • Lead capture and contact exchange features.
  • CRM, AI CRM warmup, contact management, notes, follow-up, and analytics features.
  • Administrative dashboards, templates, subscription management, and related business tools.[web:3][page:1]

Meetupcard may add, modify, suspend, or discontinue any feature, functionality, plan, integration, or portion of the Services at any time, with or without notice, subject to applicable law.


3. Account Registration and Security

You are responsible for all activity under your account and for maintaining the confidentiality of your login credentials. You must promptly notify Meetupcard of any unauthorized access, suspected breach, or misuse of your account.

Meetupcard may rely on any instruction, action, or transaction made through your account credentials as authorized by you. Meetupcard is not responsible for losses arising from your failure to maintain account security, use strong credentials, manage access permissions, or log out from shared devices.

4. Customer Content and User Responsibility

"Customer Content" means all information, data, files, text, images, branding, contact information, leads, messages, profile content, business information, documents, and other materials uploaded to, stored on, transmitted through, or generated through your use of the Services.

You retain ownership of your Customer Content, but you grant Meetupcard a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, display, format, adapt, and otherwise use Customer Content solely as necessary to operate, secure, maintain, improve, and provide the Services.

You are solely responsible for:

  • The legality, accuracy, quality, integrity, and reliability of Customer Content.
  • Obtaining all rights, permissions, notices, and consents needed to collect, use, upload, share, and process Customer Content.
  • Maintaining independent backup copies of all Customer Content, contacts, leads, exports, communications, and records.
  • Verifying the accuracy of data, analytics, AI-generated suggestions, and contact details before relying on them for business, legal, financial, or operational decisions.


5. Acceptable Use

You must not, and must not allow any third party to:

  • Use the Services for unlawful, fraudulent, abusive, misleading, defamatory, harassing, or infringing purposes.
  • Upload malware, malicious code, harmful scripts, or content that interferes with the Services or other users.
  • Reverse engineer, decompile, disassemble, scrape, copy, or exploit the Services except as expressly permitted by law.
  • Interfere with system integrity, security, performance, or availability.
  • Access the Services to build a competing service or product.
  • Use the Services to send spam, unauthorized marketing, or unlawful communications.
  • Upload or distribute content that violates privacy, publicity, intellectual property, or data protection rights.

Meetupcard may monitor compliance and may suspend or terminate access for violations.


6. Subscriptions, Fees, and Payment

Certain Services may be offered on a paid subscription, one-time fee, or custom plan basis. By purchasing a paid Service, you authorize Meetupcard or its payment processor to charge applicable fees, taxes, renewals, and other disclosed charges.

Unless otherwise stated in a written order, all fees are non-refundable, prepaid, and exclusive of taxes. Meetupcard may revise pricing, plan limits, features, or billing terms prospectively by posting updated terms or notifying you through the Services.

If payment is overdue, Meetupcard may suspend or downgrade access, delete or restrict features, or terminate the applicable account or subscription, subject to applicable law.


7. Availability, Maintenance, and Changes

Meetupcard will use commercially reasonable efforts to make the Services available, but does not guarantee uninterrupted or error-free operation. Existing Meetupcard legal pages already state that the service is provided on an "AS IS" and "AS AVAILABLE" basis and that uninterrupted availability, error-free operation, compatibility, and correction of defects are not guaranteed.[page:1]

The Services may be unavailable, delayed, degraded, or limited due to maintenance, upgrades, outages, third-party failures, Internet disruptions, telecom failures, cyber incidents, software defects, infrastructure issues, force majeure events, or other causes beyond or within Meetupcard's control. Meetupcard may perform scheduled or emergency maintenance at any time and may change technical requirements, storage practices, features, user interfaces, integrations, or workflows without liability.[page:1][page:2]


8. Data Storage, Backups, and Retention

Meetupcard may store, process, transmit, and retain Customer Content and usage data in accordance with its privacy practices. Meetupcard's current privacy disclosures state that personal data may be processed at the Company's operating offices and in other processing locations, may be shared with service providers and affiliates, and may be retained as reasonably necessary for service delivery, legal compliance, dispute resolution, and enforcement purposes.[page:2]

You acknowledge and agree that:

  • Meetupcard is not a backup or archival service.
  • You are solely responsible for creating and maintaining secure, complete, and up-to-date backups of all Customer Content.
  • Meetupcard may set storage limits, technical limits, retention periods, account restrictions, export limits, and deletion practices.
  • Customer Content may be deleted, altered, lost, corrupted, delayed, inaccessible, or unavailable due to user actions, system issues, third-party failures, migrations, integrations, maintenance, security incidents, or account suspension or termination.

Meetupcard may, but is not obligated to, assist with restoration, recovery, export, or retrieval of Customer Content.


9. No Liability for Data Loss or Service Prevention

To the maximum extent permitted by applicable law, Meetupcard shall have no liability for any loss, deletion, destruction, corruption, alteration, inaccessibility, delay, interception, disclosure, or failure to store any Customer Content, account data, usage data, leads, contacts, messages, files, configurations, exports, backups, analytics, or other information. Meetupcard's existing published terms already disclaim liability for loss of data or other information, and its privacy policy states that no method of transmission or storage is 100% secure.[page:1][page:2]

To the maximum extent permitted by applicable law, Meetupcard shall also have no liability for any prevention of use, inability to access, suspension, interruption, degradation, downtime, slowdown, service unavailability, failed delivery, failed sync, failed integrations, failed QR/NFC/contact sharing events, blocked access, account lockout, or other failure of the Services, whether caused by maintenance, updates, outages, cyber events, third-party providers, Internet or network failures, governmental action, user error, device incompatibility, force majeure, or any other cause.[page:1][web:6]

You expressly acknowledge that use of a cloud-based digital business card and CRM platform involves risks of service interruption, transmission failure, unauthorized access, and data loss, and you assume those risks. You are solely responsible for implementing business continuity measures, independent backups, export routines, device security, credential security, and contingency procedures suitable for your needs.[page:2][web:8]


10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Meetupcard and its affiliates, partners, licensors, vendors, service providers, officers, employees, agents, and representatives shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages.
  • Meetupcard shall not be liable for loss of profits, revenue, goodwill, business opportunity, customers, contracts, reputation, anticipated savings, use, data, or other intangible losses.
  • Meetupcard shall not be liable for claims arising from or relating to the Services, Customer Content, third-party services, AI outputs, reliance on analytics, unauthorized access, security incidents, business interruption, or inability to use the Services.[page:1][web:14]
  • Meetupcard's aggregate liability for all claims arising out of or relating to the Services shall not exceed the total amount paid by you to Meetupcard for the specific paid Service giving rise to the claim during the three months immediately preceding the event giving rise to the claim; if no fees were paid, Meetupcard's aggregate liability shall be zero or the minimum amount required by non-excludable law.

These limitations apply whether the claim is based on contract, tort, negligence, strict liability, statute, or any other legal theory, even if Meetupcard was advised of the possibility of such damages, and even if any limited remedy fails of its essential purpose.[page:1][web:6]


11. Disclaimer of Warranties

The Services are provided "AS IS," "AS AVAILABLE," and with all faults to the fullest extent permitted by law. Meetupcard's currently published terms already disclaim express and implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, error-free performance, and guaranteed correction of defects.[page:1]

Without limiting the foregoing, Meetupcard does not warrant that:

  • The Services will be secure, uninterrupted, timely, accurate, complete, or error-free.
  • Any data will be preserved, recoverable, or immune from loss or corruption.
  • Any digital business card, QR code, NFC interaction, CRM workflow, campaign, integration, or communication will function at all times or in all environments.
  • Any AI-generated output, recommendation, enrichment, summary, or automation will be accurate, compliant, or fit for your intended purpose.
  • The Services will meet your business, regulatory, legal, or operational requirements.


12. Third-Party Services and Integrations

The Services may contain or rely on third-party websites, payment processors, hosting providers, analytics services, communication providers, browser platforms, mobile platforms, social media services, and other integrations. Meetupcard's existing terms and privacy policy state that it does not control and is not responsible for third-party sites, services, content, privacy practices, or resulting losses.[page:1][page:2]

Meetupcard is not responsible for the availability, security, functionality, acts, omissions, or data handling practices of third-party services. Your use of third-party services is governed solely by the terms and policies of those third parties.


13. Privacy and Data Protection

Your use of the Services is also subject to Meetupcard's Privacy Policy. Current public privacy disclosures state that Meetupcard collects personal data such as names, emails, phone numbers, usage data, cookies, and device-related information; uses personal data to provide and improve the service, manage accounts, contact users, analyze usage, and support business transfers; and states that no method of Internet transmission or electronic storage is 100% secure.[page:2]

You are responsible for determining whether the Services are appropriate for your compliance obligations, including notice, consent, retention, and lawful processing requirements applicable to your use case, customers, employees, or leads.


14. Intellectual Property

Meetupcard and its licensors retain all rights, title, and interest in and to the Services, including all software, designs, trademarks, service marks, trade names, content, features, interfaces, databases, know-how, and related intellectual property, excluding Customer Content.

Except for the limited right to use the Services in accordance with these Terms, no license or ownership right is granted to you by implication, estoppel, or otherwise.


15. Suspension and Termination

Meetupcard may suspend, restrict, disable, or terminate your access to any part of the Services immediately, with or without notice, if Meetupcard believes you violated these Terms, pose a security or legal risk, fail to pay fees, create potential liability, or misuse the Services. Meetupcard's current terms already provide for immediate termination or suspension without prior notice or liability.[page:1]

Upon termination:

  • Your rights to access and use the Services immediately cease.
  • Meetupcard may delete or disable access to Customer Content, account data, settings, and stored information without liability, subject to applicable law.
  • Provisions that by their nature should survive termination will survive, including provisions on payment, intellectual property, disclaimers, limitations of liability, indemnity, disputes, and governing law.


16. Indemnification

You agree to defend, indemnify, and hold harmless Meetupcard and its affiliates, officers, employees, agents, contractors, licensors, and service providers from and against any claims, actions, liabilities, damages, judgments, losses, fines, penalties, costs, and expenses, including reasonable legal fees, arising out of or relating to:

  • Your use or misuse of the Services.
  • Your Customer Content.
  • Your violation of these Terms or applicable law.
  • Your infringement or violation of any third-party rights.
  • Any dispute between you and your customers, contacts, leads, employees, or end users.


17. Governing Law and Dispute Resolution

Meetupcard's published legal pages identify its operations in India and state that the laws of the stated country govern use of the service.[page:1][page:2]

Accordingly, these Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of laws principles. The courts located in Gurugram/Gurgaon, Haryana, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, subject to any mandatory consumer law rights that cannot be waived.

Before filing a claim, the parties shall attempt in good faith to resolve the dispute informally by written notice to the other party.

18. Changes to the Terms

Meetupcard may modify these Terms at any time by posting updated Terms on the website or through the Services. Meetupcard's current terms state that it may modify or replace the terms and that continued use after changes become effective constitutes acceptance.[page:1]

Unless a different effective date is stated, revised Terms become effective upon posting. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.


19. Miscellaneous

  • If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect, consistent with Meetupcard's current published terms.[page:1]
  • Failure to enforce any provision is not a waiver of that provision or any other provision.[page:1]
  • These Terms, together with any applicable order form, subscription terms, and Privacy Policy, constitute the entire agreement between you and Meetupcard regarding the Services.
  • Headings are for convenience only and do not affect interpretation.
